Selling Your Property? New Legislative Changes Effect You

As at 1st August 2025, changes to real estate contract law in Queensland, places new responsibilities on every vendor and agent.
Vendors of both Commercial and Residential Property will be required to provide buyers, a Form 2 Seller Disclosure before they sign a contract.
Along with the Disclosure Statement, sellers must give buyers copies of the prescribed certificates including:
- Current title search
- Registered plan
- Flooding Certificate
- Owner builder notice if unlicensed building work was carried out in the last 6 years
- Any show cause or enforcement notice under the Building Act 1975 or Planning Act 2016, if still in effect
- Any notice or order from a government or competent authority requiring work or expenditure, if still in effect
- Contaminated land search
- If the property is in a community title scheme or BUGTA scheme:

- A Body Corporate Certificate (in the approved form), or
- A written explanatory statement explaining why the certificate cannot be provided
All documents must be current at the time they are provided.
What Should You Do Next?
- If you are planning to sell your commercial property on or after 1st August 2025, ensure you are familiar with the new Form 2 Seller Disclosure requirements.
- Consult with your legal advisor to prepare all necessary documentation well in advance of listing your property for sale.
- Gather and review all relevant information about your property to complete the disclosure form accurately and thoroughly.
